Lindsay Lohan is reportedly back in rehabilitation following her third car accident in two years. But what the actress may really need is a combination of love and intense supervision, two TODAY guests said Wednesday.

“[She's] deeply troubled and in trouble,” Dr. Keith Ablow, a psychiatrist and author, told TODAY host Meredith Vieira.

“She's totally out of control,” agreed Jeanine Pirro, a former prosecutor and county judge from New York.

Lohan was charged with suspicion of driving under the influence and could face a more serious drug possession charge if police confirm that a substance found in the 20-year-old actress' car following an early morning crash Saturday in Beverly Hills is cocaine.

The New York Daily News and New York Post both published front page photos of an apparently passed-out Lohan that both tabloids said was shot by Hollywood paparazzi within 48 hours of the accident.

Vieira questioned why Lohan wasn't jailed after cracking her up her Mercedes-Benz convertible.

“If she were Lindsay Smith instead of Lindsay Lohan, she probably would have been,” Vieira said. “Is she getting a pass?”

Pirro noted that Lohan had not been arrested previously, but said that it is apparent that Hollywood nightclub owners do not seem to care that Lohan, who is under the legal drinking age, has been seen drinking in their establishments. The price of sanctions may be insignificant compared to the free publicity the clubs get each time Lohan or another celebrity becomes involved in a scandal, Pirro said.

“I think what she needs more than anything is to be under the court's direction and to monitor her behavior, because she's totally out of control,” Pirro said.

Deep-rooted issues
Ablow said reports of drinking and possible drug use are indications that Lohan has underlying emotional problems that need to be addressed.

“We know the roots of many of these things go to deep depression. That has to be explored,” he said. “I know it is very unpopular to talk about whether parents are to ‘blame’ ... but you can be a celebrity, you can be vastly sought after by your fans. But if in your heart you aren't sure you are well loved, you are going to try to deal with that pain sometimes in inappropriate ways. Drinking and partying and all of the other things she's gone through.”

Pirro countered that Lohan has to take responsibility for her actions and deal with her issues before someone gets hurt.

“Look, there are a lot of excuses for what she may or may not be doing, but the bottom line is she's violating the law,” Pirro said. “We're hearing about all of these accidents. We're lucky no one was killed in these accidents, and this is happening over and over again.”

Lohan, a New York native, began modeling when she was three and has been acting since 1996. In addition to television and movies, she also released a pop album in 2004.
