Anna Nicole Smith’s daughter with Larry Birkhead, Dannielynn, just celebrated her first birthday and as the drama continues to play out around her, she may be the only one still in the mood to celebrate anything.

Howard K. Stern was just slapped with a $100 million lawsuit by Mark Hatten, Anna Nicole’s former lover.

Currently serving a 6-year, 8-month prison sentence for making criminal threats against Smith and attacking her neighbor, Mark Hatten is the brother of Jackie Hatten, who according to Rita Cosby’s book, walked in on Howard K. Stern and Larry Birkhead, allegedly in a compromising position. Both men deny the incident.

In the lawsuit, obtained by “Access Hollywood,” Mark Hatten alleges Stern not only killed Anna Nicole and her son Daniel — claims Howard has denied in the past — but also accuses Stern of trying to murder Hatten by giving him a “toxic blend of narcotics.”

During his appearance earlier this week on “Larry King Live,” Larry Birkhead dismissed both Mark and Jackie Hatten as fame junkies.

“Her brother got into some legal trouble with Anna as far as some terroristic (sic) threats,” Birkhead said. “He’s in jail and he’s also claimed that he was the father of Dannielynn, you know, from jail.”

“Access Hollywood” has attempted to obtain 911 calls referenced in Hatten’s lawsuit but authorities said they do not keep tapes beyond 18 months.
