Lindsay Lohan relapsed in her struggle to stay sober, a lawyer for the star confirmed to Access Hollywood.

While in Italy to receive an honor for her film work, the actress was videotaped taking a drink from a champagne bottle on the dance floor at a New Year’s Eve Party.

“After being handed a champagne bottle on New Years Eve and drinking from it, fortunately Lindsay immediately stopped herself, called her sponsor and got back on track,” Lindsay’s lawyer Blair Berk told Access Hollywood. “There is no magic cure here. The most unfortunate part of this is that Lindsay has to share her ‘one day at a time’ with the entire world.”

The actress completed a 63-day stay at Utah’s Cirque Lodge rehab facility in October.

Lohan also made tabloid news in Italy during her trip to Capri by reportedly hooking up with three different men in a 24-hour span. The Daily Mail reports that one man returned to Lohan’s hotel and was photographed the next morning on her balcony, her hand resting on his bare bottom.

Slideshow: Lindsay Lohan The actress pleaded guilty in August to misdemeanor drunken driving and cocaine charges in two arrests earlier in the year.

As a result, she served 84 minutes in jail in November. She also was sentenced to three years’ probation, required to complete an 18-month alcohol-education program and spend 30 days in a residential rehabilitation clinic.
