Video: K-Fed's attorney speaks out

Attorney Mark Vincent Kaplan said his client, Kevin Federline, approves of the expanded visitation rights Britney Spears was recently given to the couple’s two toddler sons, but did not say whether Federline is thinking about reconciling with his famous ex.

“The kids are doing great,” Kaplan told TODAY’s Natalie Morales Monday in New York. “They are able to have a normal life — as normal as that can be.”

Sean Preston, 2 ½, and Jayden James, 20 months, spent Mother’s Day with their mother, who has seemed to be getting her life back together since a court placed her under the conservatorship of her father earlier this year.

“I think that it was something that was important to Kevin that the kids be able to be with their mother on Mother’s Day and with their father on Father’s Day, and I think that went well,” Kaplan said.

Safeguards in place
On May 6, a Los Angeles court granted expanded visitation rights to the 26-year-old pop star. She had lost all custody rights following a January incident that ended with her being committed to a hospital for psychiatric evaluation. On Feb. 4, Federline, her ex-husband, was granted full custody of the children. The May 6 court order, Kaplan said, was in line with Federline’s desires that Spears be more involved with raising their children.

Morales asked Kaplan if Federline is concerned that Spears could suffer another meltdown while her children are with her.

“There’s signs of progress that seem to indicate that is something that would not be a likelihood to occur again,” the attorney said. He added that there are many safeguards in place now and that all visits are strictly supervised.

There have been reports in the tabloid media that Federline and Spears have been seen kissing and are planning on working together again. Kaplan would not talk about that, reminding Morales that the couple divorced because of irreconcilable differences. He did confirm that they are civil to one another.

“I think that if you’re going to have two parents participate in the lives of raising their children, there has to be some camaraderie between them,” Kaplan said. “When you go from no visitation to some concept of shared custody, there will be an exchange of camaraderie — whether there’s more than that, I don’t know.”

50-50 custody?
Other reports have held that Spears wants a 50-50 custody arrangement with Federline, but Kaplan said his client would rather not think in terms of percentages. Rather, he said, the aspiring rapper wants a relationship in which both parents are as fully involved in the children’s lives as possible.

“It’s a significant change. It reflects improvement,” Kaplan said of the new custody arrangement. “Whether or not it’s going to go to some other expanded amount, we don’t know.”

Spears recently made a guest appearance on the television show “How I Met Your Mother.” It was so well-received that she agreed to make another appearance. The segment, which has already been taped, is to air Monday.

She has spent more time with her family, recently flying to Louisiana to take part in a baby shower for her 17-year-old sister, Jamie Lynn, who is expecting in June. Spears also has begun an exercise and nutrition program with coaches from Bally Total Fitness in an apparent attempt to get back in shape after allowing her once flawless figure to show signs of flabbiness.

Kaplan emphasized that the situation has been going on for a long time and more court hearings are in the future. The most significant hearing, he said, will be in July, when a judge will consider whether to continue Jamie Spears’ conservatorship over his daughter’s affairs.
